The guidance sets out that where developers/landowners are considering the submission of applications due to the current land supply position, then they must fully justify their case that the proposal warrants an exception to the Conwy Local Development Plan policies and represents a sustainable form of development.
The Speculative Development Guidance Note was endorsed by Cabinet in November 2015. It was not subject to public consultation so does not carry the weight of an SPG when determining planning applications. The note makes a number of references to paragraph 6.2 of the Welsh Government’s Technical Advice Note (TAN) 1, which following consultation was temporarily dis-applied by the Cabinet secretary for Energy, Planning and Rural Affairs in her written statement dated 18th July 2018. As such, parts of this note which refer to TAN1 paragraph 6.2 are no longer relevant but the Note is still considered useful in providing advice for prospective applicants.
